01 Who we are
The Sunny Digital Company, LLC (“Sunny Digital,” “we,” “us,” or “our”) is a web development and AI automation studio based in Charlotte, North Carolina, serving clients across the United States. This Privacy Policy applies to sunnydigitalcompany.com and to the services we provide directly to our clients.
By using our website or contacting us, you agree to the practices described here. If you do not agree, please do not use the site.
02 What we collect
Information you give us
You choose what to share. When you email us, call us, book a consultation, or become a client, we may collect:
- Your name, business name, and job title
- Email address and phone number
- Details about your business, goals, budget range, and the problem you want solved
- Anything else you include in a message, call, or booking form
Information collected automatically
When you visit the site, our analytics tools record standard technical data:
- IP address and approximate location (usually city-level)
- Browser type, device type, operating system, and screen size
- Pages viewed, time on page, scroll depth, and links clicked
- The site or search that referred you to us
What we do not collect
We do not ask for or store payment card numbers, Social Security numbers, or government ID numbers on this website. Client invoices are handled through separate, established payment processors that manage that information under their own security standards.
03 How we use it
We use the information above to:
- Respond to your inquiry and answer questions about our services
- Schedule and run consultations, including the free Revenue Leak Audit
- Prepare proposals, quotes, and statements of work
- Deliver, support, and improve the services you have hired us for
- Send project updates, invoices, and other service-related messages
- Understand which pages and campaigns bring in the right kind of client, so we can improve the site
- Protect against fraud, abuse, and security incidents
- Meet our legal, tax, and accounting obligations
We do not sell your personal information, and we do not share it with third parties for their own advertising purposes.
05 Third-party services
We rely on a small number of established vendors to run the business. Each one handles data under its own privacy policy, and we share only what the service needs to function:
- Google Analytics — website traffic and usage measurement
- Google Fonts — typeface delivery
- Calendly — consultation scheduling; receives the name, email, and any answers you enter when booking
- Email and calendar providers — to receive and respond to your messages
- Web hosting and domain providers — to serve this website
- Payment and accounting platforms — to invoice clients and keep our books
We may add or change vendors as the business grows. When we do, we look for providers with comparable security and privacy commitments.
06 Client data we process
When you hire us to build a website, an automation, or an analytics system, we often need access to systems that hold your data — a CRM, an inbox, a spreadsheet, a database, a scheduling tool. Some of that data may include information about your own customers and employees.
Our commitments when handling client data:
- We access only what the project requires, and only for as long as it requires it
- We use it solely to deliver the services you engaged us for — never for our own marketing
- We keep it confidential, subject to any signed NDA or service agreement between us
- We return or delete working copies at your request when the engagement ends
- Where an automation routes data through a third-party platform, we tell you which platforms are involved before it goes live
If you are an individual whose data was given to us by one of our clients, that client controls that information. Please contact them directly with access or deletion requests, and we will support them in responding.
07 AI tools
AI automation is part of what we build and part of how we work. We use AI platforms such as OpenAI and Anthropic, and automation platforms such as n8n, Make, and Zapier, to design and run client workflows.
- We prefer business and enterprise tiers that exclude customer content from provider model training
- We avoid putting sensitive personal information into general-purpose AI tools unless a client has approved it in writing for that specific workflow
- Automated output is reviewed by a person before it drives a consequential decision
- AI-assisted systems can make mistakes; we design workflows with human checkpoints where accuracy matters
08 Calls, texts & email
When you call or text the number listed on this site, we receive your phone number and the content of your message. Calls may be answered or assisted by an automated voice assistant that takes your details and helps schedule a consultation.
If a call is recorded or transcribed, you will be told at the start of the call and given the chance to decline. We use recordings only to capture project requirements accurately and to improve how we handle inquiries.
Messaging consent. Giving us your phone number lets us contact you about your inquiry or project. We don't send marketing texts to people who haven't asked for them. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for help.
10 How long we keep it
We keep information only as long as it's useful or required:
- Inquiries that don't become projects — up to 24 months, then deleted
- Active client records — for the duration of the engagement
- Contracts, invoices, and tax records — at least 7 years, as required for tax and accounting purposes
- Client system access and credentials — revoked at the end of the engagement
- Analytics data — retained per Google Analytics settings, currently 14 months
You can ask us to delete your information sooner — see Section 12.
11 Security
We take practical, proportionate steps to protect information: encrypted connections (HTTPS) on our site, multi-factor authentication on business accounts, a password manager rather than shared or reused passwords, least-privilege access to client systems, and prompt revocation of access when a project ends.
No method of transmission or storage is completely secure, and we can't guarantee absolute security. If a breach ever affects your personal information, we will notify you and any required authorities as the law requires.
12 Your rights & choices
Wherever you live, you can ask us to:
- Access — tell you what personal information we hold about you
- Correct — fix anything that's inaccurate or out of date
- Delete — remove your information, except what we must keep for legal or tax reasons
- Port — send you a copy in a portable format
- Opt out — stop receiving non-essential email or texts from us at any time
Email jimmyfrank@sunnydigitalcompany.com and we'll respond within 30 days. We may need to verify your identity before acting on a request, and we won't discriminate against you for exercising any of these rights.
13 State privacy rights
Residents of California, Colorado, Connecticut, Virginia, Utah, Texas, and other states with comprehensive privacy laws have the rights listed in Section 12, plus the right to opt out of the sale or sharing of personal information and of targeted advertising.
We do not sell or share personal information as those laws define it, and we do not run targeted advertising. There is nothing to opt out of, but the request channel is the same email address above.
California residents may also designate an authorized agent to submit a request, and may appeal a denied request by replying to our response. Under California's “Shine the Light” law, we confirm that we do not disclose personal information to third parties for their direct marketing use.
14 International visitors
We operate from the United States, and any information you send us is processed and stored here. U.S. privacy laws may differ from those in your country.
If you are in the European Economic Area or the United Kingdom, we process your information on the basis of your consent, our legitimate interest in running and improving our business, or the necessity of performing a contract with you. You have the right to access, correct, delete, restrict, or object to our processing of your data, to withdraw consent at any time, and to lodge a complaint with your local supervisory authority.
15 Children's privacy
Our services are built for businesses, and this site is not directed at children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with information, email us and we'll delete it.
16 Links to other sites
Our site links to client projects, partner platforms, and social profiles we don't control. Once you follow a link off our site, this policy no longer applies. We'd encourage you to read the privacy policy of any site you visit.
17 Changes to this policy
We'll update this policy when our practices, tools, or legal obligations change. The “Last updated” date at the top always reflects the current version. If a change materially affects how we handle your information, we'll make it obvious — by notice on this page or by email to active clients. Continuing to use the site after an update means you accept the revised policy.
